Welcome to Smoke N Roll. These Terms of Service ("Terms") govern your access to and use of the website operated at this domain (the "Site"), our physical retail location at 5775 Airport Blvd #725c, Austin, TX 78752, and any related delivery, ordering, or customer service offered by Smoke N Roll ("we," "us," or "our"). By accessing the Site or purchasing from us, you agree to be bound by these Terms. If you do not agree, do not use the Site or our services.

Smoke N Roll sells products intended for adults 21 years of age or older. By using the Site or purchasing from us, you represent and warrant that you are at least 21 years old and legally permitted to purchase tobacco, vape, nicotine, hemp-derived, kratom, and related products under the laws of the State of Texas and your local jurisdiction.

We reserve the right to refuse service, terminate accounts, cancel orders, and require government-issued photo identification at the time of purchase or delivery. Federal and Texas law require age verification at delivery; orders may not be left with anyone under 21.

We sell smoke shop products including, without limitation: disposable vapes and e-cigarettes, e-liquids, glass and accessories, cigars and cigarillos, hookah and shisha, rolling papers and wraps, nicotine pouches, kratom, and hemp-derived cannabinoid products that comply with the federal Agriculture Improvement Act of 2018 (the "2018 Farm Bill") and Texas House Bill 1325.

All products are sold strictly for lawful use by adults. Products are not intended to diagnose, treat, cure, or prevent any disease and have not been evaluated by the U.S. Food and Drug Administration. You are solely responsible for understanding and complying with all federal, Texas, and local laws governing the purchase, possession, and use of any product we sell.

Online ordering and same-day delivery are fulfilled through our third-party delivery partner, Saucey. When you click an order or delivery link on our Site, you may be directed to Saucey's platform, which is governed by Saucey's own terms and privacy policy. Pricing, availability, delivery zones, fees, and order acceptance for delivery orders are controlled by that platform.

All deliveries require the recipient to present a valid government-issued photo ID showing proof of age (21+). Deliveries will be refused if ID cannot be produced, if the recipient appears intoxicated, or if delivery would otherwise violate applicable law.

We make reasonable efforts to ensure pricing and product information on the Site is accurate, but errors may occur. We reserve the right to correct errors, change prices, modify product descriptions, limit quantities, and refuse or cancel any order at our discretion, including after an order has been submitted. If we cancel an order you have already paid for, you will receive a refund to your original payment method.

Due to the nature of the products we sell, most items are non-returnable and non-refundable once opened, used, or removed from sealed packaging. Defective products may be eligible for exchange in accordance with the manufacturer's warranty. Contact us within 7 days of purchase at support@smokenroll.net or (512) 243-6748 to request a return authorization. Refunds, when granted, are issued to the original payment method.

All content on the Site — including text, graphics, logos, photographs, the Smoke N Roll name and mascot, button icons, images, and software — is the property of Smoke N Roll or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent.

You agree not to:

• Use the Site if you are under 21 years of age;
• Use the Site for any unlawful purpose or in violation of any applicable law;
• Attempt to gain unauthorized access to any portion of the Site, our systems, or other users' data;
• Introduce viruses, malware, or other malicious code;
• Scrape, harvest, or collect information from the Site by automated means without our written consent;
• Misrepresent your identity or age, or purchase products on behalf of any person under 21.

The Site may contain links to third-party websites and services, including Saucey, Google Maps, Instagram, and Facebook. We do not control and are not responsible for the content, policies, or practices of any third party. Your interactions with third-party services are governed by the applicable third party's terms and policies.

The Site and all products and services are provided on an "as is" and "as available" basis. To the fullest extent permitted by Texas and applicable law, Smoke N Roll disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses.

To the fullest extent permitted by law, in no event shall Smoke N Roll, its owners, officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of the Site or our products. Our total aggregate liability for any claim arising from these Terms or your use of the Site shall not exceed the amount you paid us in the six (6) months preceding the event giving rise to the claim, or $100, whichever is greater.

You agree to indemnify, defend, and hold harmless Smoke N Roll and its affiliates from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. You agree that any legal action or proceeding arising out of or related to these Terms or the Site shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of those courts.

We may update these Terms from time to time. When we do, we will revise the "Effective Date" at the top of this page. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
